I've got 30% fronts and 15% rears.....they cut us a lot a slack with window tint out here in the SoCal desert which is a must have....As long as the cops can see your hands on the steering wheels from outside the vehicle they pretty much let you slide (at least out here in the desert!)....

California does NOT allow tint of any kind on the front windows.
Some county courts allow you to not fix equipment infractions and just pay the fine.
Unfortunally for me, my county does not.
I had to remove the tint, have the ticket signed off by law enforcement (done today) then go to the court clerk and pay $25.00 court fees.

On the plus side.
I was given the tint ticket instead of one for 97 MPH.
Also I have been driving for over 57 years, most of them in cars with tinted windows.
This is the very first ticket for tint.
Technically this one shouldn't count either because I was really stopped for speed (data logging).

Wow...That actually sounds like a "huge" PLUS to me.... all things considered...he could have looked further under the hood as well if he wanted to be a real "you know what"....

Dave, California does allow tinted windows, what it does not allow is for the reflectivity of the window tint to be less than the standard windows. A tint that allows 70% of the light to be transmitted is allowed on the side windows. No tint is allowed on the front windshield below 4" from the top. Is that what you got ticketed for?

I thought the same thing, so I asked.

Current California Vehicle Code # 26708

26708. (a) (1) A person shall not drive any motor vehicle with any
object or material placed, displayed, installed, affixed, or applied
upon the windshield or side or rear windows.
(2) A person shall not drive any motor vehicle with any object or
material placed, displayed, installed, affixed, or applied in or upon
the vehicle that obstructs or reduces the driver's clear view
through the windshield or side windows.

Note the fraise and also note the word CLEAR.

reduces the driver's clear view through the windshield or side windows.

This is the LAW and it will standup in court.

Keep in mind that most cops use the tint law as an excuse to pull someone over for other suspected violations...As my neighbor (who is a CHP) told me as long as they can see both your face and hands on the wheel clearly through the tint they are not going to go out of their way to pull you over unless they suspect there is more of a violation to be had...And unfortunately in your case Dave you were excessively speeding and the cop (who sounded like a nice guy) chose to not ticket you for speeding and needed to find something else to make it worth his while and give reason as to why he pulled you over in the first place by issuing a minor infraction...at least that's how I see it...

That said, as we all know, there are no guarantees.....particularly at the end of the month when cops need to meet their quotas!!

Of this I totally agree and I have NO complaints.

Just need to go to the court tomorrow to get this finished.
Then I can have the windows tinted again.

BTW the photo below is the way it was and will be again.

Yep, I got pulled over for a loud exhaust, that was not loud at all and a couple of Harleys when by and I could not even hear the cop talking to me.....then I got a ticket for a turbo on a none turbo car. That cost a few hundred bucks, take it all off, buy some parts I no longer had, get it inspected, go to court, next day, put it all back on.

---------------

Today I got my NASA inspection to take the car to the track:):)
Everyone at the shop loved it.

And my buddy who is a service manager at Toyota got a ride in the car and loved it.

Ford Service manager and a tech checked it out and talked to me for almost and hour about it.

Lots of FiSt love today:)

There is actually more information in the CVC that you quoted, that covers window tinting and window obstruction. 26708(a), which you quoted, and the following subparagraphs which covers tinting. It is up to the discretion of the officer which section of the CVC he wants to ticket you for. One is a fine and proof of compliance, and the other is a fine only. As you said, you previously got away without a fine. Sounds like this officer did not have enough proof to get you for speeding, so he hit you in the pocketbook. You need to satisfy all provisions of the exemption, including the note, which I carry in my glove compartment. My brother-in law is a sherrif and he informed me of all of this information. You need to find an installer that is familiar with the information required to satisfy the officer and the CVC. That being said, any law enforcement officer can ticket anyone at anytime, as it is only a notice to appear, and not an admission of guilt.

(d) Notwithstanding subdivision (a), clear, colorless, and
transparent material may be installed, affixed, or applied to the
front side windows, located to the immediate left and right of the
front seat if the following conditions are met:
(1) The material has a minimum visible light transmittance of 88
percent.
(2) The window glazing with the material applied meets all
requirements of Federal Motor Vehicle Safety Standard No. 205 (49
C.F.R. 571.205), including the specified minimum light transmittance
of 70 percent and the abrasion resistance of AS-14 glazing, as
specified in that federal standard.
(3) The material is designed and manufactured to enhance the
ability of the existing window glass to block the sun's harmful
ultraviolet A rays.
(4) The driver has in his or her possession, or within the
vehicle, a certificate signed by the installing company certifying
that the windows with the material installed meet the requirements of
this subdivision and the certificate identifies the installing
company and the material's manufacturer by full name and street
address, or, if the material was installed by the vehicle owner, a
certificate signed by the material's manufacturer certifying that the
windows with the material installed according to manufacturer's
instructions meet the requirements of this subdivision and the
certificate identifies the material's manufacturer by full name and
street address.
(5) If the material described in this subdivision tears or
bubbles, or is otherwise worn to prohibit clear vision, it shall be
removed or replaced.

This is the hard part.

The material has a minimum visible light transmittance of 88
percent.

I have only been able to find 70%.
Besides anything more than 50% looks bad.

Tolerance of the meters used to find an 88 or 70% transmission allows me to use 70% without consequence. So for all purposes, I'm compliant. If you show the officer the note, they typically back off. I use 3M ceramic at a local place in Riveside. My sides are light, but the back and rear are very dark, so it makes the front sides look darker.

I may or may not have been "better than nothing".
