Small claims threat because he misrepresentation the CBE. This guy is a joke. Exhaust shop measured the pipes and it was 2.0 and 3.0 tips. Not even close to 2.25 and 3.19. And he states that the exhaust tips were in the correct location for the ST...

Guys states that the system was ordered and installed by the dealership prior to delivery so that's the way it's supposed to be...what a joke.

The old dealership ordered and installed it. Like that's always right. Lesson learned never trust ebay or "great deals".

Hope you paid with your credit card. File a claim with too. Along with ebay. This way you for sure you will get your money bad. Also make sure to leave bad feedback. More than likely he will get booted from eBay.

Filed a claim with eBay. Paid with PayPal and he is filing a ebay counter claim saying the product was as advertised and was meant for an ST.

was anything stipulated for returns in his ad, such as "all sales final" or "restocking fee", etc. kinda disconcerting a customer can't return something regardless of the reason.

Did you pay with pal credit or your bank or credit card through PayPal?

If you paid with a Credit Card via PayPal have them reverse the charge. I would also suggest saving the ebay listing into a PDF file for evidence.

I paid with PayPal using the debit account. Listing was marked no returns/refunds but I filed a claim with eBay money back guarantee as the CBE I bought was not as advertised ie for an ST. Seller is filing a counterclaim and treating small claims court for the full price and attorney fees.

Ridiculous that the seller won't acknowledge that he sold me a CBE for a base model Fiesta. His claim is that FRPP does not make an exhaust for the base Fiestas and that what was installed and ordered by his dealership was correct for an ST as his was delivered with this wrong CBE.

There are 2 for the base Fiesta a Cat back: M-5230-FAC

and
an axle back M-5230-FAB
http://fordperformanceracingparts.com/parts/part_details.asp?PartKeyField=22599

BTW the ST is also heavier than the Base Fiesta variant.

Good luck

I have sold a ton on ebay, their is more buyer protection than seller protection. Its really not up to the seller anyway, if you file a complaint with ebay then they will pay f you for the refund and yank the funds from him. But you have to pay for return shipping and provide a tracking number. The buyer can return anything for any reason, as long as no damage . Good luck.
